Your Contractor Insurance Questions Answered

A public liability policy will usually cover all projects up to your limit of liability.

Yes, this is quite normal and is usually required when multiple parties share an interest in a project.

A public liability policy requires property damage or personal injury to occur for the policy to respond in the event of a claim. If personal injury and property damage doesn’t occur than a professional indemnity can in some instances provide cover for “any financial loss”. A Professional Indemnity isn’t available to all occupations so it would need to be considered on a case by case basis.

In Australia, contractors insurance and public liability are treated as the same. Other countries refer to policies differently however, most contractors require public liability insurance in the first instance which is why it is usually referred to as contractors insurance. Or, it is used as a broad terminology of the “contractors insurance” that is specific to your role. For example, public liability, portable tools cover and professional indemnity.

If the use of subcontractors are declared on your policy than your policy will usually cover you for the negligence of the contractor however, it is likely, depending on your contractor agreement your insurer may seek recovery from the subcontractors insurance.

All policies are written on an annual basis – they can be cancelled at anytime however, some insurers and policies incur a minimum and deposit premium meaning that if cancelled mid-term there may or may not be a refund applicable. It is not the intention of a policy to be taken out and then cancelled when the project finishes and then taken out again at the commencement of your next project. Most insurers and Brokers will refuse to offer cover if this is the case.

Most policies are written on an occurrence basis which means that as long as there was a valid policy in place when the incident “occurred” then cover will be provided for previous work.
